THE HEALTH & SAFETY AT WORK 1974

Brief explanation on the following points:

The main aims of the Health and Safety at Work etc Act 1974.

The Health and Safety at Work Act 1974 aims to guarantee a safe working environment for employees, temporary workers and the public by ensuring employers take the responsibility of installing fire safety equipment and considerable management of hazard waste. The Act also ensures staff are trained on manual handling to increase competency. Moreover, risk assessments are carried out to identify high risk factors and put measures to mitigate them.

What is meant by statutory legislation?

Statutory legislation is a written law created by the parliament of United Kingdom.

What are the general duties placed on employers with regard to:

  1. Plant and systems of work

To provide plants and systems of work that are safe and free from health risks.

  1. Handling and storage of articles

Ensuring substances and articles are handled, transported and stored carefully to reduce health related risks.

  1. Training and supervision

To provide instructions, training and supervision of employees in connection to protecting their health and safety.

  1. The workplace

To provide and maintain a workplace that is without health risks and has safe means of access and egress.

  1. The working environment
  2. To provide and maintain a working environment with adequate facilities arranged well for the welfare of employees at work (HSE, 1974).

The duties on employers to persons who are not their employees but who may be affected by their activities.

Ensuring that other people besides his employees affected by the enterprise are not exposed to health and safety risks.

The two duties imposed on employees while at work.

To take the health and safety responsibility of himself and others who might be affected by his actions.

To cooperate with the employer in undertaking or complying with any duty imposed on the employer.

What provision does the HSWA make for the misuse of safety equipment

No one should misuse any equipment intended to protect health and safety in pursuing statutory provision (HSE, 1974).

What is the general purpose of the Electricity at Work Regulations 1989

To govern the use of electricity by employers, employees and self-employed with the interest of minimising danger.

What duties are imposed by Regulation 3 (E at W Regs)

Self- employed and employers to comply with the Electricity at work Regulations in undertaking matters within their control.

Systems should be maintained at all times to prevent danger.

Equipment provided under the Electricity at Work Regulations should be maintained in a good condition and used for the intended work.

Taking precautions while working on or near a dead equipment to avoid charging it electrically if danger may arise.

What is the purpose of Regulation 14 (E at W Regs)

To minimise the chances of live working and ensuring compliance of precautions when working on or near live conductors.

Under what circumstances is it permissible for a trainee to work on electrical systems where technical knowledge or experience is required Regulation 16 (E at W Regs)

If he is under supervision in regard to the work.

If he possesses knowledge and experience necessary for the work (HSE, 1989).

Workshop safety:

Check Risk Assessments

Risk assessment involves identifying a risk and applying the appropriate measures to mitigate it. The law requires an employer to assess risks to self, employees and members of the public who may be affected by his undertakings. Moreover, occasional reviewing of the assessment is necessary to ensure all changes are included.

What PPE is required

Eye protection, safety helmets, gloves, safety footwear, high visibility clothing, and safety harnesses (HSE, 2022).

Rules for working in the workshop area

Controlled use of naked flames

Dealing with spillages as soon as possible

Ensuring the workshop cables are well organised to avoid trailing.

Knowing how to use extinguishers (Health and Safety Authority, n,d).
